Rent and vehicle recovery

Dear Sir, My name is Sujit Nair. I have a Tata safari storme, I leased the vehicle for a period of 11 months. As per contract, the 2nd party has to pay the monthly rent of Rs.20,000 per month on 5th of every month with a grace period of 5 extra days. If rent not paid within grace period, 10% fine will be imposed on the 2nd party as delay payment after 10th. The contract also states that ,Nither party can terminate the contract within 11 months, and in doing so the 11 months rent i.e 2,20000 to be paid as compensation which is applicable to both parties who ever wish to terminate the contract.The contract ending date is 6th os sep. 2018. Now my problem is , the 2nnd party has not paid me since march 2018. I called him many times after due date till this month, we also had argument i asked him to clear his debt. but now he is saying he dont have money and he will pay only when the agreement finishes, and also refusing to pay the due amount as well not agreeing for a mutual discontinuation.And also refusing to give the vehicle. I have his blank cheque , but my only doubt with cheque is his name is not mentioned in the cheque.The contract is legally notarary stamped and.signed. Please suggest me how to recover my debt and vehicle. Rgds Sujit Nair
