No reply to communication of society
WE are a housing society of central Armed Forces personnel comprising of about 600 flats at Raj Nagar Ext, Ghaziabad UP. We have a duly elected " Apartment Owners Association" which was registered in 2015. Presently we have 330 members and membership is still on since we have persons deployed in difficult areas of the country also. . Recent Elections were held under direction of DM and under personal presence of SDM on 25th March 2018. Builder is still having full control of the project. Despite having clear provision under Sec 14(5) of apartment Act 2010 and directions from Ghaziabad Development Authority builder has not yet handed over management of Maintenance to AOA and charging at very high rates. After recent elections AOA has written 20 letters to builder in connection with Security and other related issues including asking him to hand over management of maintenance to AOA but he is in habit of and not responding to any of our communications. Our question is that whether under any legal provision Builder Company is liable or under obligation to anser the communication of registered society ?
