For partitioning immovable properties one of the daughters is not Co-operating. Solution please.
My father had 2 wives. First wife (periamma) had no issues. 2nd wife, my mother has 3 sons & 2 daughters. My father passed away first and after some years our Periamma also died intestate. The land and house properties are in the joint names of my father & his first wife (periamma). On account of employment, we sons, left the village. My mother and two daughters who are our sisters were residing in the house and cultivated paddy field and enjoyed the fruit. They never gave any benefit to any of us (I.e) for the 3 sons. We, sons also did not demand any benefit and had no regret since they are our sisters and were residing with and taking care of our mother . In the meantime, the first daughter left the house during 1987 without anybody’s knowledge and got married as per her wish and lived with him. After she conceived, she returned and lived with our mother and delivered a male baby. Subsequently she separated from her husband and continued to live with my mother. In the meantime we conducted marriage to 2nd daughter who is our second sister. After a short time she also returned from her husband and continued to live with our mother. Now my mother and 2 sisters along with the male child continued to live in the house and attended to cultivation and derived the benefit. Our mother also passed in 2013. Now there are 3 sons & two daughters (i.e) 3, brothers & 2 sisters . Two daughters (our 2 sisters) & son of our first sister (who is major) are residing in the house and attending to cultivation. As usual we, sons didn’t receive any benefi from the above properties. So, we 3 sons & one of the sisters who is youngest decided to partition the properties. In the meantime, our first sister along with her son constructed a house at the backside of existing house and are unwilling for the execution portition for the reasons know to them. We solicit your valuable opinion for partitioning the properties.
