Property distribution after father's death
Hi Sir/Mam,
Its regarding property purchased by my late grand father in 1955. Below is family members description.
Grand Father- Died - Approx 1979 June
Grand Mother- Died - Approx 1977 June
My Grand father has 5 child(2 Son and 3 Daughter)
Daughter 1: Born before 1947 in Pakistan, Current status: Not alive
Daughter 2: Born before 1947 in Pakistan, Current status: Not alive
Son 3: Born before 1947 in Pakistan, Current status: Not alive
Daughter 4: Born in 1947 in Pakistan, Current status: Alive
Son 5(My Father- Youngest Child): Born around 1954/1955, Current status: Alive
My Aunt's[Daughter 1, 2- Not alive] have their own child(Daughter & Son) further.
Now property settlement need to make between Son 5(My Father) and successor of 3rd Son [Single Male child].
Note Land papers have been made in 1955 to my Grand Father name and right now he and his 3 child(2 Elder daughter and 1 Son) are not alive.
Query-1) In Above case, Daughters are eligible for share in property?
Note: Although my Aunt (Daughter 4) and successor of (Daughter 1,2) never had(nor now) objection but they all are far away from my place So it would be difficult for all of them to present physically as witness and certify the settlement.
Query-2) If Query-1 answer is *Yes* then Is there any way, as in:
a) Any Argument,
b) No objection certificate from successors/shareholders and
c) 1956-2005 Hindu Succession law
by which we can distribute property between Son 5 and successor of 3rd Son without other shareholders presence?
