Injunction suite on construction

Hello sir/madam We purchased a property in a layout and registered on our name and we payed almost 90 percent of money to the builder and he dint construct the building from fast two years all in the layout and asking extra money from us in ur agreement he wrote he will finish the villa in 11 months and if not he will pay us 8000 rs and for some people he dint even give construction agreement also we gave add in paper he dint response we filed a case in police station also not to distrube construction in middle we started our construction over self with our own contracter but now he filed a case on us in civil court that we dint support him but bank people came to site and had a look and dint released the money because owner told not to realise the money what ever money came from bank was used to his(builder)other new projects and we asked him he will tell we will finish but also we believe him and again we payed him some money but also he dint even touch the building and we r waiting for so many years he dint even finished the project almost from 5 years we r waiting now he is trying to get injunction on the layout because we r constructing our self and how many years a construction agreement will expire and some people is not having construction agreement so pls help us to what to do.....
