Ancestral property
The said property was in the name of Great Grandfather, he passed away in 1978 or so and subsequently, the other family members occupied it.
1. GGF (Great Grandfather) had 1 son from II wife,
2. And he had 4 sons and 4 daughters from 3rd wife.
3. Total 5 sons.
4. First son from third wife was given for adoption.(i.e. 2nd son out of the total 5 sons)
5. One property was occupied by first sons family.
6. Third and fifth son sold their shares in mutual understanding.
7. Fourth Son had no children and he is not on good terms.
8. Fourth Son first made a document in his name that the property is his inherited.
Then he transferred it in his wife’s name
and then the wife donated the property to temple,
which was accepted and returned after 8 years,
as it was having legal problems (Misrepresentation of facts and No Objection certificate was missing).
9. The fourth son’s wife passed away in 2017, and he donated that said property to the son of his Younger Brother (Fifth son).
10. The said person (Son of 5th) wanted to sell it and approached two people from the first Sons family.
11. One person was not interested and the other person agreed to buy and gave an offer.
12. The said person did not accept the offer and without informing the family members and without taking a confirmation from the families he sold it to an outsider of the family.
13. The sale was done in October 2017 and it was found out in March 2nd week of 2018.
14. The person who gave the offer wants to buy as it is his Great Grandfather’s property and has emotional value to it.
15. What are the remedies available and what can be done to get the family property back.
