Provision Under Pagdi Tenancy Law
Hello,
We are a secular family with parents and 4 brothers.
My Grand Father taken a shop in as tenant in the year 1982, and since then he have been doing his business in that shop. The shop has been rented out to us under Pagdi system.
The shop agreement was on my grand father’s name, and after his demise, the landlord is saying to make fresh agreement with them as he is saying that pagdi agreement with your grand father not with you.
In this scenario, I wish to know the following:
1) Now Can my father run the shop with old pagdi agreement or not as per the law?
2) The Landlord has stop taking the monthly rental with us and not issuing the rent receipt to us? what should we do this case?
3) What landlord can do in this case? can he/she force fully vacate our shop from us? or what legal action he can take?
4) What precaution should we take to avoid problem in future?
5) Is there any issue if my father holding one more shop in his name?
6) Should it necessary that the shop is run in the name of my father or should it be run by us also.
Please guide us, as we are not sure about the rights as tenants. We are really worried that we might lose our shop after my grand father death.
