Cgtsme npa loan future after borrower's death
Hi Sir,
I am looking for your suggestion :
My Father took a term loan to buy public bus of amount 9 lacs from SBI under CGTSME scheme (unsecured loan) in 2010 in terms of 5 years to repay.
After taking loan for 2 years he continued to repay but after that the business was in so bad condition that he could not repay it.
And as a I know from 2014 the the Bank declared the loan account as NPA
Now my father has died in last December from Cancer and then I decided to meet bank authority for settlement
I offered them 25% of the loan amount that is near about 2.5 lacs
But they are claiming 4 lacs, that I cannot afford because :
my mother has no money except a 1 lac LIC policy and 5,0000 Post office papers (which was only joint property). Moreover we had to take loan from other relatives for my fathers treatment
I have a job, I am married woman and I am just looking after my mother from my salary only, so I can't even pay more that 2.5 lac at this moment
But my father had a flat, the legal heirs of which are myself and my mother
Now bank is neither ciezeing the bus nor sent us any legal notice. But they are mentally torturing us to pay 4 lacs or demanding I have to give them a letter stating that my father has died so I want to handover the bus to them, after that taking the scrap value of the bus they will charge the rest amount from me
But I am not agreed with any of their proposal
and also the bus is also not in running condition now as the bus is already damaged and also no insurance covered as we could not do name transfer (its only my father's / bank's property)
Now my question is:
1> if they file lawsuit, court can take out our flat and also the money which is joint property of myself and my mother inherited from joint property of myself, my mother & my father?
2> if they file lawsuit, court give me write off so that I will not be able to take any loan further for any of my personal requirement or for my husband's requirement?
1> if they file lawsuit, court can take out any property which is in joint with my Husband only?
