Sir, my maternal grandfather and his brother inherited a commercial property from his father in the year 1965. Since then both brothers had been running the business peacefully till 2007. But in the year 2007, the nephews of my grandfather forcefully grabbed the said property after his father's death. They also filed a civil suit against my grandfather in 2008 claiming that the property belongs to his father but this suit was dismissed on 17 August last year in my grandfather' favour stating that both parties have equal share in the property. Again, they filed FAT in High Court but on 6 december my grandfather too passed away. My maternal grandmother is alive.
Sir, my question is what can we do to take the premises legally or seal the said property so that neither party can run the business. They have been running the business since 2008 and we are facing irreparable loss and injury. My advocate said that we are not entitled for Execution order because my grandfather was defendant. sir we have very strong evidence but not getting justice. Please guide me what we can do.
