Dispute in Father's self acquired property
Sir, Can you kindly advise on the following property matter :
My Father had built a residential house [only Ground Floor] in Bangalore more than 30 years ago. He purchased vacant site and built ground floor house out of his own self-earned income. In the same property, myself built 8 Squares house on the first floor investing my own funds. My Younger brother built 10 squares house [Rooms] in the same property investing his money. Both the Brothers are getting rent from these Rooms but after the expiry of my Father in 1996, the property Khatha has been transferred to my Mother's name. Even to this day, the Khatha stands in my Mother's name. In 2015 my Mother also expired. Now my younger Sister [who got married in 1992] and myself are asking my Brother that we 3 together should sell the house and share the sale proceeds equally amongst ourselves. But my Brother is refusing to sell , he is refusing for partition of house also. Even for a sitting to discuss with him, he is postponing the meeting since 2 years. Can you kindly advise what myself and my younger sister should do ?. Is my sister [aged 50 years now] has got equal share in Father's self acquired property ?. The market value of the house, as on today, is around Rs.1.20 Crore. I shall be grateful to you for your kind advise. Thanks. Manjunath
