Termination of Employee
Sir i am working in a private organisation as HR Asst since 4 yrs and we received a legal notice from labour court one month back to attend hearing in case of an ex-employee who was orally terminated by management in the year 2004, as concerned HOD's & HR manager have resigned who were looking after this case earlier, company lawyer informed me to attend the hearing and Hon'ble Judge informed to submit vakalatnama along with relevant documents and said from next hearing onwards either company MD or lawyer has to attend the case and not a representative. But neither management or company lawyer is supporting or providing reqd. documents to be submitted at court due to this i couldn't attend next hearing and now company lawyer telling that its HR Asst duty to attend the company legal cases.
Sir i respect the orders of the court, but without having support from management and not having any case history / details how can a HR Asst attend the hearings at court and moreover i am unable to answer the questions asked at labour court by lawyer. My question is company legal cases will be looked by company lawyer or by HR Asst and what should i do in this case, Please advise.
