Need urgent solution
On May 2017 I reached out to ** employee for personal loan and told him about my requirement of Rs 7 to 8 Lakhs for house renovation and asked him about my eligibility. After providing all the details, he called me back and told me that I am eligible for Rs 7 Lakhs. He will dispatch Rs 7 lakhs in two installments. On first installment he will give me Rs 5 Lakhs and after 6 months he will give me rest Rs 2 Lakhs and the interest rate will be 12.99% with processing fee of 0.5%. When the amount got credit on my account, it was only Rs 2.44 Lakhs. I immediately gave a call to that EE and told him that as per our discussion till today morning, I was supposed to get a loan of Rs 5 Lakhs on first installment and the interest rate and processing fee charged is also very high. He replied me "Due to bachelor accommodation we are unable to dispatch Rs 5 lakhs on next month after paying your first EMI just give me a call, we will process for another Rs 3 Lakhs with interest rate of 11.49%. As per the discussion and commitment made over phone with that EE, I have started my house renovation process. I have paid to the labor to start the work and purchased raw material for cash and credit considering completing the work asap as my leaves are limited and will pay to the creditor after receiving second installment loan amount (i.e, next month). After paying my first EMI I gave a call to that ee and his manager and dropped couple of mails too. Neither they have picked up my call nor did they reply to my emails. After few days without finding any solution I have raised a complaint to the customer care. On next day of the complaint that ee called me and told me that he will process my loan after 40-45 days, just to give him little time. Due to some policy he can't dispatch my loan now and also told if I get a call from customer care then just to say them that I have discussed with him and I am satisfy with the resolution. After 45 days I gave couple of calls to him but he didn't picked up my calls. Again I raised a complaint to the customer care and on next day he called me and told me he will process my loan on the month of October. Due to lack of money I was unable to continue my work and also most of the raw materials damaged due to rain. I used my credit card to pay the bills to the creditors. On November I gave a call to that EE and after checking my eligibility he told me that I am not eligible for the loan because I have swiped my credit card for making a payment of Rs 2.5 Lakhs. I am dragged in such a financial condition that I even don’t have money to pay EMIs.
I have most of the call records. When I received a call from that bank’s lawyer, I discussed everything with him. He told me that call records are not a valid proof. Court will reject it. I have to pay the money or they will issue me a non-bailable warrant for 2 years soon. Please suggest
