Can company treat me as absconding even after intimating them in advance
I have Resigned from the company dated 16 Nov 2017 and on the same day i have informed them that it won't be possible for me to complete full notice period due to personal issues. So i dropped them a mail stating that i will serve only 16 days notice in place of 30 days for rest 14 days I'm ready to payoff from my salary.
I have moved out of Organization after completing 16 days.
I have submitted all companies asset and handed over my work to other employee.
Resignation was accepted but they deny to relive me earlier.
Appointment clause for notice period - The contract of employment is terminable without reason, by either party giving one month's prior written period during probationary period and two months prior written notice on confirmation of employment. Company reserve the right to pay or recover in lieu of notice period. Further company may its discretion relive you as from date fit even prior to the expiry of notice period. However if the management desires the employees to continue the employment during the notice period, the employee shall do so.
As i followed the process as I'm liable to get relieving letter or if they treat me as absconding that can be done legally to get relieving letter.
