How to get my money back

01/01/2017 I met Mr. Amitendra Mishra at His office in Sante Majra, Sector 115, Mohali, Punjab. Then he has shown me an under construction 2 BHK 1140 Sq. Ft flat in Noor Homes, Sector 115, Mohali. I liked the flat as rooms were good and Amitendra assured me of some add on facilities. So Amitendra Mishra introduced me to Mr. Pankaj Sood – G.M. (M/s Land Twisters). Then the Pankaj Sood Finalized the deal in Rs. 23.20 Lacs and asked me to book the flat with booking amount of Rs. 50000/- . But as I was not having such a huge amount ready with us. So I made a cash swipe of Rs. 14000/- from my ICICI debit Card in account of M/s Land Twister. M/s Land Twister provided Booking form no. 899 to me for this, a copy of which is attached herewith. 05/01/2017 Mr. Amitendra Mishra came to my house at SBP North valley to collect a cheque for rest of the booking amount of Rs. 36000/- and particulars of the same were noted down in the booking form and signed by Amitendra. I have given a cheque of ICICI bank bearing no. 024109 of Rs. 36000 in favour of M/s Land Twister. 12/01/2017 Mr. Pankaj Sood called me to submit cheques of Rs. 3 Lac in favour of M/s Land Twister By 15/01/2017 and I agreed. 15/01/2017 I went to Land Twister office in Sante Majra and handed over two cheques of ICICI bank worth Rs. 1 Lac and Rs. 2 Lacs bearing cheque nos. respectively to Pankaj Sood. Then in afternoon I called Amitendra Mishra and told him that I have handed over the cheques to Mr. Pankaj Sood. Amitendra behaved in very odd way and said to me, “Why you handed over the cheques to Pankaj Sood? He is not owner of that house. At the time of booking, I have taken you to Pankaj Sood only for providing you the booking amount receipt. You immediately stop payment of those cheques. Actual owner of the house is Mr. Krishan Gopal Lamba” I was shocked that earlier he has told me nothing about it. But to be safe I Called ICICI bank and stopped the payments. 16/01/2017 Mr. Amitendra Mishra called me and told me that on 18/01/2017 evening, we will meet Mr. Lamba. He asked me to bring a cheque of Rs. 1 Lac and assured me that Mr. Lamba can easily take out your booking amount from Mr. Pankaj Sood. So I was comfortable and I agreed. 18/01/2017 We went to Mr. Lamba house in Kharar and Mr. Amitendra narrated him the whole story. Amitendra Asked Mr. Lamba to show all the documents and proofs of his ownership of flat. Earlier he was a stakeholder in the society and after detaching himself from the company, he has been given some flats against his stakes. All the documents were OK for me. Mr. Lamba assured me that Pankaj Sood cannot take money from me for his flat and on a single police complaint, he will return whole amount.
