Pagri Property Transfer Issue

Hello We have one Pagri Property in the name of my grand father, the redevelopment of this property takes places in 2007, and still possession will be received next year 2018. now at the time of redevelopment movement property have been transferred in my mother name (Along with document of death certificate of my father and grand father). Now we are two brothers, i want to take full charge of property, by way of 100% gift from Mom and NOC From brother, further also going to register Release deed for relinquish right of mother and brother, Because i want to go for Loan against property and bank will not fund on Gift Deed, they will accept the release deed. now bank also wants NOC from Builder as society not formed and OC not received, and even possession not given (after Redevelopment) now the question IS whether Bank needs NOC from Builder for giving me a Loan, further if i request builder for giving NOC, whether he would ask for 33% Share (Pagri Property) on the ground that release deed created where we mention what amount i have paid to my brother to avoid future issue. Since i need simply take over this property in my name and want to take Loan Against Property. whether it can be simply done by not involving Builder in any case whether at time of preparing release deed.
