Dispute of well situated in our land.
According to land title deed our land boundary is the (private) road and there is a well which is attached in our land but in title deed nothing is written about that well. We use that well for irrigation purposes and our neighbour also uses it for irrigation purpose . Two separate motors of agricultural purpose is there .One is of ours which is inside our boundary and the other one is outside the boundary in private road which is of neighbour's. Neighbour's house is after the road . Now a days due to shortage of water there is dispute apart from that when we planted a tree inside our boundary near to well they cut the plant saying leaves will fall in well and root will also destroy it. Because of dispute we want our well back for our personal purposes and does not want to share with them . the Neighbours says they have the right to use as they are using for more than 30years but does not have any property right in well. If we go to court whether we can stop neighbour from using the well and if yes how long approx it will take.
