Property related matter in a mess
I am a legal heir of a property in my Grandfather's name who passed away in 1995. My grandmother passed away in 2001 and my father passed away in 2009. None of them left behind any will. My father has a younger brother who is still alive. The ancestral property which was 300sqyards was divided between my father and his younger brother on mutual consent when my grandfather was alive and we now a wall running through the property dividing the two sides as agreed.
My father is survived by myself, my mother and my 2 elder sisters who are married. My chacha is in no mood to progress the mutation of the property for reasons known to him. And, I don't wish to file a court case given the time, money and efforts it takes to resolve such issues. Now keeping in view the background, I have the following queries - I wish to construct a shop on my side of the property and rent it out to a bank as an ATM.
In case my chacha has no objection, will the lease/rent agreement between me and my tenant legally valid given that I am not the owner and only a legal heir?
If yes, will I be able to register this agreement with an SDM(just to be on a safer side) being only a legal heir of the property and not the owner?
Can the tenant take advantage of this situation(that I am a legal heir) later and refuse to vacate the premises?
