Co-owned land stats after a mutual divorce
I am a divorcee for over 2 years now and our was a mutual divorce settlement where i have the custody of our 2 daughters and my ex-husband pays Rs. 2500 towards my younger daughter. My elder daughter is over 18 years, so he is not legally bound to do anything for her. He does not visit his children and calls them once in a blue moon. We own a property which was bought with my dad's money but as my ex-husband insisted on buying it in both our names. Divorce decree says that the land has to be sold within 1 year of divorce or else partition can be done. Until now attempting at selling has not come to fruition. He has taken back the power of attorney he had given to me as he is a NRI.
My elder daughter has to be married off in another 2-3 years and I have a younger daughter too. My ex-husband has remarried and seeing the attachment he has left for his daughters I am sure he will not even be in the picture for their education or marriage. Until now I was willing to settle for the half proceeds from the land even though he has not put in a penny towards buying that land, but now I have to think abt my daughters too, I want to know if it is legally possible to acquire that land completely. Would you kindly advise of the legal proceedings? I work from home and have to carry the home loan EMI and all my kids expenses too and have not asked for money from my ex-husband for anything.
