What legal rights a contract employee have
Working as AGM( contractual role for max 5 years) in CMSS ( autonomous body under MOHFW) . My 6 months probation has been increased for another 6 months although there was no provision for extension in our contract. post one year, it was again put up for 6 months of extension which Governing body has refused and asked to take approval of Chairman on file. After that Company as issued a show cause notice again stating delay and errors in work which was replied well within the time giving all reasons for delays . now company after pressuring for so many days to resign finally issued termination order . this was not reviewed by any panel and i have not given any further chance to explain my part. my point of contention is there was uneven work distribution and multiple jobs were assigned to me on a contrary my colleagues were given less jobs. i had to stretch my working hours and work on most of sat sundays in order to finish the job assigned. All work were done as per priority and as per instructions given my reporting manager and DG&CEO. So, any such allegations for delays are absurd and unjustified. I have not done these jobs in isolation, any such reports are being signed by committee members needless to say detail discussion has gone before signing any such documents by the members then why this SCN was issued to me.
in one the similar case https://indiankanoon.org/doc/167014160/ court has said no natural justice is there for contractual employee.
what to understand do i hold any right to fight. can i fight against any such discrimination.
if so , Can i take this to CAT?
