Tenant not vacating house. Agreement was not made

We are having house in Ambala City Haryana. We had given on rent to a bank employee in 2002. Earlier 3-4 years back we told him to vacate the house, as we need to repair the house and we need it as my father was about to retire from his service. He always used to say that I will do it very soon. My father retirement date is 30 November 2017. So after that we have to vacate the government house and we need our house. Last year in November 2016, we received a notice from court that our tenant had issued that we are disturbing him by visiting our house again and again, he wrote in the notice that his family is living and we are disturbing him. The problem is we hadn't made any agreement at that time in 2002. So in November 2016 itself we hired a lawyer and put a case for vacating our house, but we are dates again and again. The issue is not getting resolved, Next month in November 2017 we need our house, as my father is getting retired from his service. and our house needs alot of repair. What can we do now please guide.
