Land dispute
We bought a land in year Feb,2012 where the executant executed the sale deed but failed to appear at registrar office so we had to apply for the compulsory registration.
Registrar has summonded all 3 executant.., among which one has appeared infront of him and agreed that he has executed the sale deed(signed the sale deed) but do not like to sell the property.
other two executant has not appeared before the registrat at all so the sub registrat refused the registration and recommended to apply to district registrar with in 30 days time.
We applied to District registrar at the right time(within 30 days time) for DR(district registrar) to do the enquiry, afterwhich, in the year 2014, all the 3 executant (who already signed our sale deed) has sold the same property to his close relatives(Mrs.usha).
Mr.Ram who is husband of Mrs,usha has also joined along with other 3 (who signed my sale deed) when it was sold to Mrs.usha
We also served the legal notice to their close relatives (Mrs.usha) who bought the land for the second time but there was no response from them on the legal notice.
Also Mrs.usha has sold the same piece of land in the year March, 2017 to another person Mr.YYY.
DR has started the inquiry (on the application that we gave them on 2012) on June 2017 and summoned all 3 executant who initially executed the sale deed, goodthing is that all the 3 executant has accepted the execution and they all willing to sell the land now(willing for registration aswell).
Mrs.usha somehow came to know about the enquiry at registrar office and they wanted to stop this registration.
Note:as our sale deed was kept pending registration it will not be available to public so Mrs.usha and Mr.ram was able to do the fradulent sale.
so can the registrar register my document without any problem?? because as per registration act 1908, registrar should check for the identitiy and check on the execution.
in my case executant has accepted the executed infront of the registrar and also willing to sell the land to us and my sale deed is the first one so i think all the subsequent registration will not make any sense.
