Property boundaries changed
Dear all,
My father purchased a site in 1983 which was surrounded by cultivating lands. There was a proposed east-west road to the south of our property by that time and the boundaries in the document is mentioned as the property is to the north of east-west road and to the south of the land of the seller. This has been mentioned in the mother document as well.
After the purchase made by my father, the remaining cultivating lands are converted into layouts in 1985 and the proposed east-west road was converted into a layout. Then the seller converted his cultivating land which is in the north of our property as east-west road.
Now, my father is in the process of passing a gift deed to me. In this case, do we need to pass a rectification deed to change the boundaries before passing gift deed? If this is the case, then we need to change the mother document as well which is not possible now.
Or shall we go ahead with passing the gift deed with old boundaries itself but with added lines that shows new boundaries?
Please guide us.
