Owner (Landlord) Refusing to Refund Rent & Security of a Flat
I rented a flat at Dwarka Delhi on September 2, 2017. The owner took the following considerations from me
1. Rent for September 2017 and society charges (Rs 23,500 via Paytm and 2450 in cash)
2. Security deposit of 2 months (SELF Cheque - Rs 47,000 now encashed)
3. Agreement & Police verification expenses (Rs 3000 in cash)
The keys were given to us on Sep 2. However we found that certain repairs were due in the house, so the owner took back the keys for repairing on Sep 5. Subsequently when we took back keys on Sep 8 we realized that house has seepage in one bathroom, termites were seen in most of the places. We immediately clicked a photograph and sent it to owner for remedial action.
The owner not only refused to get the treatment done but also started advising us that now it was our house and we should get it done. Fortunately no agreement was executed with him till then, this lead an argument and we decided not to take the house on rent. The owner also was not willing to share his pan card details and details required for claiming HRA.
Now he is not returning our rent and not even returning the security amount. He further states that till he gets a new tenant he will not give us anything and moreover the commission he will have to pay to agent will be recovered from us
Please advise the remedy how can I get my hard earned money back
