Buying a house with land from a party having clear partition deed
Dear sir, i want to purchase an independent house with land from a party who has two brothers, the party has clear partition deed of his portion of property with site plan clearly marked the area of the portion, the property tax is being paid by the party in his name for his portion. in the partition deed it is written that some common area like walk way passage will be used by all parties commonly. in the deed it is clearly written that " none of the parties shall be entitled to sell or otherwise transfer his allotment to a stranger unless he has first offered the same to the other parties and in case only when they or each one of them have refused to take the same at the best available market price". Here the other party or parties neither agreed to purchase nor ready to give in written or sign that they do not have any objections. My queries, in this case whether purchasing of the property from seller with out any written consent from other parties is safe? and in future no legal problem will come and also no legal problem to use the common passage will come.
