Broker fraud
Dear Sir,
I had contacted a broker in Mira Road (Mumbai) for finding a house for rent.
He charges 2 months brokerage + registration charges. (14000+2000=Rs.16000).
He had taken 5000 as token advance for initiating talks at builder office for approval as the new building is not under any co-operative society but directly under builder.
After talks with approving member at builder's office, my application got approved.
The broker told that I have to give him the remaining Rs.11,000 or else he will not initiate talks with owner and also will not give back the Rs.5,000.
Hence I have given him the 11,000. (Both 5,000 and 11,000 transferred using net banking and I am having proof of the same.)
Now the house owner has rejected me at the last moment saying that I am a bachelor. Now the broker is saying that he will give money back in another 1 or 2 days. (He is saying like this for the past 2 months everytime I call but not giving anything back despite continuous follow ups.) He is also saying that he will block my number if I disturb him by calling more than one time per day. If he wishes he will speak on a particular day or otherwise he will not pick up calls. He is also saying that I have to talk to him in a friendly manner. If I try being rude, he will not give anything back.
I understood that he will not give back my money.
Kindly advise how can I proceed legally against him.
