Drt property dealing with ots holder
I am MahaRERA registered estate agent . Recently I have sold a property of Bank Mortgaged property with written court concent terms file by mortgagor. As per said terms and condition mortgagors can settle his full and final settlement account of OTS on or before certain period . Now my client has already paid to bank entire amount of OTS to said Bank .
We have taken search and also issued 14 days public notice to but we found no body claimant.
Since last 7 days due to some public holiday Bank has yet not issue E C certificate and registered release deed. But issued a letter to said mortgagor stating that bank has received full and final amount of OTS .
Now I have one question in my mind under this cercomstaces can we enter and / execute sale deed without waiting EC certificate or release deed . We have already enter into MOU with the consultation of our Advocate .
Please suggest me precosionory steps to prevent any fraud or cheating with purchaser and safeguard the interest of purchasers.
