Consumer law for refund for faulty brand new bike
I bought a UM RENEGADE SPORTS bike worth around 2lac from SILICON CITY UM Bangalore and it was delivered to me with torn back seat paddle and torn/damaged brand name logo stickers on the fuel tank and showroom and service team promised to change during first service because they did not have a stock of it, it was unpleasant for me to get bike delivered.
After 3 or 4 days i noticed oil leakage from the engine area and i immediately informed the showroom but they said it can be rectified in the first service, but I still called the road side assistance they adviced not ride the bike and they had my bike towed away to nearest showroom and after till next day there was no update regarding my bike and only after me calling them they said that they are expecting a service from company to attend issue, their casual approach and their irresponsible answers forced me cal the company directly and spoke to the team and they said they will look into issue. On 3rd day service engineer attended the issue he explained the possibility of the leakage and he also said it's only the gasket which has problem but I still was insisting for refund or replacement , so he said for my satisfaction he will change entire head assembly so that problem will be solved for ever. By thier promise and assurances i asked them to move on then he changed head assembly , back seat paddle and logo,
The company and the service engineer gave me very strong assurance that same issue won't occur again and based on their assurances i took back my back and now after 3 just months and i rode only 1666 km now there is again oil leakage but now from head of the engine, i informed the company and service engineer and they asked pics of same
This time i does not want a repair but a refund if not atleast replacement for the faulty brand new bike.
I have lodged a complaint against company thru national consumer helpline also.
Pls advice whether can i get refund for my bike if yes what is the procedure
Company is not any mood to refund or to replace
