Domestic LPG insurance claim due to accident.
Dear Advocate,
Re: LPG Gas leakage accident - Advise required for claiming compensation.
Due to HP Gas ( LPG leakage at our house ) 3 persons were injured severely.
FIR was filed at our local police station and charge sheet is under process.
Incident details:
Incident Date: 11th March 2017 10.00 AM.
Persons Injured: 3 Females (1 HP GAS SV holder and her daughter + 1 Neighbours who came to help Gas holders).
Reason for Accident: When regulator was unplugged from the gas cylinder leakage happened. Seeing the leakage Mother and daughter came out of house and sought help to stop the leakage. Another women came in to stop the gas leakage. However gas catched fire from the Lamp (Diya which was lit during Pooja ).Victims couldn't notice the fire and went in side to see if they stop the leakage from Cylinder and caught fire.
Medical Investigation report Details:
Mother - aged 45 - 45 % burn Area.
Daughter _ Aged 25 - 15 % burn Area.
Neighbour - Aged 32 - 50% Burn Area.
Medical Charges incurred for treatment - 5 Lakhs for HP Gas Holders.
- 3 Lakhs for 2.55 Lakhs for Neighbours.
Property Damage ( Doors and Roof plates) approximately 50,000.
Current status: Dealer has submitted claim to insurance company in the month of May.
HP Gas Distributor and Sales manager said that they has applied for insurance and awaiting Insurance company response.
They have submitted all the medical bills and injured person photographs for insurance company assessment.
Now as a victims son I don't have any knowledge on the insurance process and how much time it takes for processing the claim amount by the insurance company?
How much amount they can refund?
what is the actual amount as a consumer I will be compensated if I approach legally ( via Civil or consumer court) or is it better to wait and see how much insurance company can compensate ?
Kindly advise.
Thanks for your response in advance.
Regards,
Suresh.
