Loan disbursement done without consent
I have loan sanction of Rs 1.3 Crores for a property with a reputable bank. However to date with 80% of the payment done, I have sought disbursement of only Rs 43L. Very recently I received the demand for last 20%. As per normal practice I sent a copy of the demand letter to one of the bank's loan banking representative. I mentioned to him however that as earlier I will intimate the exact amount to disburse after checking what I can release from my side. I also sought an extension of 1 month from the developer to allow myself time to arrange funds and same was given. However to my dismay I noted that without my consent bank released a cheque for the entire 20% to the developer. I immediately asked the bank to stop payment and made a complaint to the consumer care. The bank was able to stop payment and got the cheque back from the developer the very next day. Now 2 weeks later I receive a call from another person from the loan banking dept that the I have to pay excess EMI. Bear in mind that the payment is never made. I have a habit of maintaining just a little excess of the agreed EMI amount hence the bank is unable to withdraw more than my original or earlier EMI. My question is can banks increase EMI without disbursing additional money? Regards Satyaki
