Need to evict a shop owner under pagdi system
I am the Landlord of a building in Mumbai and all flats and shops are on Pagdi system of tenancy. Because of the Rent Control Act I cannot increase rent. Rent for each shop and flats is in the range of Rs.250-300. After paying all taxes there is no money left that I earn. The building is old and requires repairs and many small maintenance jobs need to be done, and a few years back, I have retired and have no other source of income. There is one tenant in my building who is occupying 2 commercial shops. I want to take one of the 2 commercial premises so that i can start some small business and support my family and myself. The tenant was paying regularly and has maintained the premises but since last 7 monthes he hasn't paid the rent but if i issue a notice he surely will pay and i have no other choice than to evict him from one of the shops as i have no other source of income.
My questions are:-
1.What can be done in such a case?
2.Is evicting him feasible?
3.What are the complications that may arise out of this incase we go for court proceedings?
