Unfair Educational/Service Practices by US Agency
Dear Sir,
As a PG Student based out of Noida Can i get your valuable advice on the following case.
1. There is a US based non profit Organization offering several Certificate course worldwide across several countries since for last several years.
2. Therefore large number of Indian also goes through these certification Programme every year.
3. As per rough estimate/ data available for last year 15,000-20,000 Indian has received certification out of several thousand candidates.
4. Examination happens online through their registered agencies located in several Indian cities.
5. Organization has office in India, but the entire control is in US hand. Indian office does not have any power or authority.
6. For the purpose of appearing the exam, a candidate will have to register himself/herself online and pay US $ 550/-(Approx Rs.35,000) for one certification exam
7. Organization does not declare passing marks or marks obtained by the candidate. They only declare pass or fail. So nobody knows as on date what is the passing percent or marks in the exam. They does not give marks sheet or grade card.
8. If a candidate fail the exam he/she will have to pay another US $ 300/- for reappearing the exam.
9. All candidate willing to appear certification programme will have to mandatorily go through training programme with registered training centre of the organization for which training provider will charge another Rs.15,000/- per certificate
10. Organization does not declare how many candidate from which country has appeared exam and how many of them has passed the exam. Everybody only throws guess number.
11. Organization gives syllabus but no previous year question paper. Since examination is a online examination, nobody can copy any question back to home from exam hall. No paper is allowed in the exam.
12. As per the agency, all legal jurisdiction is at Washington, US.
Under the circumstances, my question is
1. It seems that NO INDIAN LEGAL/EDUCATIONAL SYSTEM including UGC or AITEC has any control over this organization, when the organization is syphoning huge amount of money(Million plus) every year from India in the name of giving Professional Certificate without maintaining basic fundamental level of transperancy
2. As per my limited understanding all educational provider located in India has to come under either UGC or AITEC and they have to follow rules and regulations of UGC or AITEC.
3. Can anybody take this organization to Indian court(High Court or Supreme Court) on several issues/loopholes listed above or since Jurisdiction is stated as Washington, US hence any legal suit can be filed only in US court not in Indian Court.
4. Does the above organization violates UNFAIR TRADE PRACTICES under WTO(GATS-General Agreement on Trade and Services)
