Transfer fees gujarat co-op housing society
Dear Sir,
I have recently purchased a flat in Surat city of Gujarat state in resale.
The building in which the flat is located is fairly new and no society is formed legally as of yet, only a group of flat holders formed an unofficial society which is not registered under gujarat co-op housing society act(as per the best of my knowledge)
Because the so called head of society is denying to show the registration certificate.
And hence no member sharing certificate was issued to the previous owner as the society is yet to be formed legally.
Still they are asking me to pay Rs.50,000 as transfer fee and even denying to show me the registration of society certificate by the registerer.
My question is can they legally charge "transfer fee" if they haven't registered their society under gujarat co-op housing society act and/or haven't issued member sharing certificate to the previous owner.
How can they charge transfer fee when transfer term is invalid in this regard as their is no member certificate to be transfered to my name.
