Panchayat license for shops and apply penalty for construction without land conversion My father has constructed a commercial building (ground floor, 10 shops) at his own land which is Revenue land. Before construction he has given application on 30- Jan-2021 to Gram Panchayat for seeking construction permission. But they have not replied to his application till 8 months of his application submission date. Father started construction in June 2021 and mid of construction someone has complained that construction is illegal and land conversion not done. So, PDO issued 2 notice and father did not replied to PDO notice. In between father applied for land conversion (2month back) and have acknowledgement and still in progress as it goes multiple departments. When shops guys tried to open shops (Bakery, cutting shop, tailoring) PDO stopped it without issuing notice saying construction of building is illegal and not taken panchayat license. Now shops guys made agreement with my father and applied for license to Gram Panchayat. Out of 15 Panchayat member 12 member supported and given a letter (proceedings) to issue license as many other people got license from Panchayat without land conversion and cannot stop for my father alone. We also requested to put penalty and regularize as per Panchayat Raj act 1993 , section 292, 298 and Karnataka government Gazette issued on 28th Dec 2021 copy. But due to political pressure PDO and EO not issuing the license and keeping hold license saying without conversion we do not issue license where same guys (PDO, EO) issued for others before. PDO has given reply letter saying without land conversion we will not issue trade license and do not take tax for property. We have taken appeal to EO but he is dragging from pas 2 months without any order. Kindly let me know what we can do get license. Let me know 1.) How we can get license and regularize constructed building as land conversion application process is taking too much of time. 2.) Is possible to get direction from high court to open our shops 3.) We requested CEO of Panchayat also, but no use. 4.) What is next step if I want to open our shops without meeting to PDO and EO as they do not give license.
