Cutting my one month rent as advance for Painting Charges
I moved in the Apartment in mid feb and he did not tell us his intention of selling his flat at that time.
After a month he start showing the flat for selling so I called him and he promised that he will take care of getting a new house and shifting. I also asked him to keep me aware.
However he sold the house on 29th May and dropped us a mail on 04th Jun that they have sold the house and this is the new owner, also stating that they have transferred the security deposit to new owner. So I dropped him a mail saying that I had an agreement with you so please transfer the deposit back to me, its upto me to continue the agreement with new owner.
Seems theres been some issue happened between them so now they have sent me a mail as one month notice and saying they will deduct the one month rent for painting charges.
House paint is still shining and new. I told them its unfair as we have not even completed 11 month, how can you deduct paintin charges in just four months where the paint is still like a brand new and you have even sold the house. As per owner as per agreement you have to pay the painting charges and this is the norm in Bangalore. I am felling exploited, painting generally happens in 3 years.
Is there a way to save our money, consumer court or any legal action we can take.
