Tenant absconding and no rental agreement with tenant
I have rented my property for the last 10 months. At the time of giving the property on rent, the tenant agreed to have a rental agreement done once he settles in the flat. However, after continuously following up with him, he kept on delaying although he used to deposit rent regularly (6 months) in my account and also gave initial deposit in cash.
Since last 4 months, the tenant is absconding and I'm unable to trace him as I don't have enough information about him. Somehow I reached his hometown where I did not meet him but on inquiring with his neighbors, realized that the person is a fraudster and has already duped many people by sweet-talking and even there's a track record of him with police in his hometown.
While duping these people, he might have given my property address because of which a couple of people reached me to inquire about his whereabouts and I avoided a conversation with them to avoid further complications. As he has duped so many people, I am presuming that he will not come back to the property in near future.
Key Points -
1. No rental agreement exists with tenant.
2. Tenant has his lock in place on the property but is absconding since 3-4 months.
3. A couple of people reached my property in order to trace him and I'm worrying that they might approach police and give my property details after which I might come into trouble.
4. As he has duped several people, there's hardly a possibility that he'll come into picture in later point of time and claim his right over the property, however we cannot completely deny the possibility.
Few questions -
1. How do I take possession of my property in such a case? Steps involved and practical time-frame until possession?
2. How do I respond if someone comes over my property and inquires about him and threatens to file a complaint (I am not in direct business with them but my property would be at risk right?)
3. In the absence of a rental agreement, how strong is he if he happens to claim tenancy right over the property in future?
4. How appropriate is it if I take possession of my property using force and in later point of time completely deny any form of association with this tenant as there is no document that says the person is my tenant?
