Non compete ,non solicitation and nda
Hi , I am Piyush , I work for IT MNC after working for 1 year , I had decided to resign since this company was laying off in huge numbers.
but 1 week before my resignation ,my mnc company had asked me to report to one of the their client, from where I had got the direct offer, they said that your profile was already shared with the client and you have contract with them, I had decided not to join this client as vendor and did not disclose them that I have offer since I had direct offer ,i took 1 week leave and then resigned , and said some personal reason for resignation and got early release from the company , now I have got the relieving letter as well. But now, when I have joined the client as employee I see there are employees from my last employer and I am worried if they will report to my last employer HR and they can file lawsuit or legal notice as I am not sure if I have signed any non compete ,non solicitation ,nda clause during the offer of employment with my last employer , as I heard from some people that there is clause of 6 months restriction in offer of employment.
1. what action my last employer can take on me? for breaching non compete ?
2. I have checked the offer there is no such clause in my last employer offer ,but they say digial signature would have been signed by your during the acceptance of offer.
3. it's a big mnc and the client which I joined as direct employee is also a big client for them.
4. if there is any poaching agreement in between them then would employee has to suffer ?
5. the hr of the company which I have joined ,knew that I am from a company whose employee work there as vendor. but never asked me do you have any contract as vendor and ,offered me appointment letter.
6. as I had never reported to the client as vendor ,but they say you have contract does this non compete still valid true even after getting reliving letter.
can I work in this organization with out any panic or should I think to search for new job.?
