How to break Partnership

DEAR SIR, I was in Job and went in to verbal partnership in December 2014. My partner is "financial partner" and he gave me 40 k per month up to February 2016 but he raised form 16 also which is applicable in IT for employees. I am "working partner" but could not be able to touch break-even so far and therefore Money given by my partner is now to liability on me. ( App 7-8 lacs after deducting official expenses) As per verbal agreement, he promised to give me business through his own firm for worth Rs. 60,000/- per month but he did not fulfil his promise and now said, " I did not promise you that I will give regular monthly business" (1)- Since there is written and legal agreement done by both of us, he can not claim his money from me if I don't pay him his dues. (2)- Secondly, since he raised form 16 twice for financial year 14-15 and 15-16, I can prove in court that I was indeed an Employee of his firm. Although, I can not submit any appointment letter against my employment. (3)- He has stopped paying 40 k per month as agreed, but I am using commission for our official and personal use which is being earned by business being done. ( We are still partner) Sir, my question is, If I break this partnership and do my business independently, without paying him his dues, can he file any legal case against me to claim his dues ? Although, I am honestly interested to refund his dues from my *earning. ( *It was very clear in our understanding that I will never return his dues from my pocket, but will be adjusted in Business profit only. )
