Illtreatment and harassment at workplace
1. I am a retired Army Officer. From 08 August 2016 to 01 March 2017 I
was performing the duties of Consultant Airport Terminal Officer ( a
contractual appointment for 3 years) with AAI in Trivandrum Airport.
I stopped doing duty due to following reasons:
(a) Airport Director(APD) and other regular employees in TVM
Airport didnot want the contractual appointment to succeed as they
fear this will affect their regular intake.
(b) Appointment given by APD was menial and not commensurate to
managerial appointment assured by AAI advt 05/2015 and job letter
issued by Central Headquarter (CHQ). I was placed below Airport
Managers (APM) and made to do menial jobs. There is a crunch of APMs
and regular Officers from other dept. were pulled in for APM. Inspite
of this, they didn't have the heart to employee me respectfully.
(b) Illtreatment by APD, APM and supervisors which included
reemployed Ex- Serviceman. I had no protection against illtreatment
by Group C employees because APD had created a worse environment not
fit for working, for me.
(c) No Office given to me inspite of me being an Officer inspite
of my request. There were days, I had to stand in rain outside
Airport.
(d) No Closed holidays given. The reason given was that job letter
was silent on Closed and Restricted Holidays. The job letter says 01
CL per month on pro rata basis.
(e) 12 hours continuous working / day. Morning shift on Monday
and Thursday and Night shift on Thursday and Friday. Sunday was only
weekly off. The APMs who are some way or other equivalent, had two
weekly offs and there were more APMs appointed than the number of
shifts. T he terms and condition for my appointment and appointment
doesnot speak off ni shift and 12 hours work which is against Labour
Law.
3. From the above facts, it would be quite clear by now the intention
of APD, APMs and other HR Officials.
4. I, Kindly request for advice on the following:-
(a) Legal remedies available to me?
(b) Can I file a case against in the name of Mr. Goerge Tharakan
who is the sole reason to all my above problems? Since I have seen
cases against appointments getting longer.
(c) Can I file this case in HR Court in my district?
(d) How much compensation can I seek from Mr Tharakan because due
to whom I, who stood on borders fighting Terrorists, has suffered loss
of job, is facing odds due to present job recession, is without
salary from March and had to suffer relocation from Trivandrum, 7
months after start of settlement, children admitted to local school
etc.
