Being Harassed by a Recovery Agent
Hi,
I used to use Bank of Baroda's credit card in October 2004 and used it till Q1 2008. I paid full and final amount to the Bank's main Janpath, New Delhi branch and the lady, after receiving the money from me, she destroyed the card and threw the same in the dustbin.
Now from last 4-5 years, after every 2 year I gets a call from BOB's recovery agent saying that you have done a fraud and as on date your total outstanding is of 89000/- so pay the same.
I told the agent that I don't have any outstandings, nor do I have any document to support the same as in 2009 my mom expired and I sold my home so all the papers too were discarded as I was sure that Bank has done it's part in closing my account and everything was over. By this agent keeps calling me every 2 years and behaves very rudely over the phone. I told him that if he's so sure that I have done a fraud then he needs to file a police complaint, only then will I take any legal action which is is not ready to do, he just insists on doing an "Out of Court" settlement. Also, I was told by a colleague of mine that since my case is almost 10 years old, no agent can call and harrass me for the recovery of the same as the time has barred for the same. Had i been the defaulter, bank as per their policy, should have contacted me i=within their 90 days period which never happened, I first got the call in 2010 (2 years after I made the full and final payment).
Please advice as I'm mentally very disturbed with this agent calling me again and again and uses bad names not just for me but for my family also.
