Job Notice Period
I want to change my job & in my current job in my appointment letter it is specified “This appointment is terminable at any time by giving 90 days’ notice on either side without assigning any reasons. Breach of this condition would entitle the company to recover the necessary compensation in lieu of notice period.”
This appointment letter was received by me via mail however still I have not given my acceptance on this appointment letter I have not signed & sent the scan copy to the HO as required in their main & in the mail in which I received this appointment I had already replied as; “I have received the appointment letter sent by you & i have gone through all of the conditions given in the appointment contract & also i agree to all of those conditions except just one condition which is stated in point no. 9. Point no. 9 stipulates the condition of 3 months prior notice before termination of contract & failing to compliance of which the company will be entitled to claim necessary compensation in lieu of notice period from my side.
Sir with all due regard, this condition in not agreeable although i agree to the condition of giving 90 days prior notice from my side but i cannot agree on this compensation part.”
I need some advice of legal experts regarding protection of my rights, maximum of my notice period which I can serve is 1.5 to 2 months only. Do I have to follow their condition of compensation or I have some options as per the Indian Law?
