Application of Horizontal reservation in matters of recruitment

Grievance against wrongful application of Horizontal Reservation Policy Sir, Through this letter I wish to draw your kind attention towards the result of post code 132/12, wherein the board, quoting the policy of horizontal reservation has kept a seat from Unreserved category vacant for the next recruitment, which is a gross misinterpretation of both the Horizontal reservation policy as well as the concerned Advertisement no. 02/2012. First of all the facts are quoted below for the context: DSSSB vide its advertisement no. 02/2012 with closing date 15/06/2012, had advertised the number of vacancies 43 (UR-23, OBC-13, SC-07) including OH-1, VH-1 for the post of Post Graduate Teacher English, Male in Directorate of Education under Post Code 132/ 2012. The board had conducted Tier-1 examination on 30/11/2014 and Tier –II examination on 28/06/2015. As per Tier-I result, a number of 210 candidates ( UR-145, OBC-33, SC-32) were shortlisted for the Tier-II exam. Among them 4 OH candidates (UR-4, OBC-0,SC-0) were shortlisted for Tier-II examination. It is important to note here that no Visually Handicapped candidate was shortlisted in any of the three categories: UR, OBC, and SC for the Tier-II examination. Later on the basis of the merit list of Tier-II examination, a number of 41 candidates (UR-21+1 OH=22, OBC-12, SC-6+1 pending=7) were selected, against the 43 advertised vacancies (UR-23, OBC-13, SC-7). Since the Board did not find suitable candidates, one seat in the OBC category and one seat in the VH category were kept vacant.. Now the dispute is that the board, on the basis of Horizontal reservation policy has kept ONE seat from Unreserved category vacant for a VH candidate, whose vertical category was not even mentioned in the advertisement, whereas in the concerned advertisement the number of vacancies under Unreserved category were stated to be 23. This has left the 22nd rank holder, who was competing for 23 vacancies of Unreserved category, aggrieved with the result. sir, now please guide me in the context of my mentioned arguments so that I can pursue my case with DSSSB.
