My brotherin law filed a divorce petition at kolkata against which my sister straight way approached Honble Supreme Court for stay n transfer of civil matter at Lucknow. Honble Supreme Court turned down both the petition of my sister. When approach kolkata court it came to notice that on second date of the case ( within 10 days of first date) the kolkata court decided the case expartee in favour of my brother in law, without commenting upon any compensation/ alimony for my sister. No copy of decree order was served to my sister at her address. The recall order application was filed/moved within 90 days. However prior to receipt ( falling after 90 days , 92nd dqy precise) of notice of recall case filed by my sister he got married second time. Question: whether as per rule provision expartee divorce decree without compensation/ alimony can b passed. 2. 90 days time for appeal is to b counted from the passing of decree or from the date of receipt of decree order by the respondent ( sister) in this case.
