Rental Agreement - Non Renewal
Hi, i was staying in a rental flat in Bangalore agreement from March 16 to Jan 2017. Agreement was not renewed & i vacated the house on April 6th.
As per the agreement notice period was 60 days, one month rent for painting and cleaning the house and if agreement was renewed then rent was supposed to be hiked by Rs 1000.
I have served 40+ days notice period and paid March month rent.
Following are my issues.
1.Owner has holded a month rent and is deducting 1 week rent, maintenance, water, EB etc.
2.Now he is deducting more money saying i have not served full notice period and clearly said no refund and will be adjusted against not fulfilling notice period.
3.I have painted the house, cleaned instead of paying the one month rent. Now he is saying that i have not painted the doors, grills and roof so asking me to pay me one month rent.
4.Effective Feb 2017 i was supposed to pay new rent of Rs 23000 but he said it was waived as goodwill (But agreement was not renewed and no new contract was signed)
5.I vacated the house as on 6th April and new tenant occupied as on 7th April so there is no loss of income to owner, i was willing to spend the full 60 days since new tenant wanted to come in vacated the house on priority.
Questions.
1.Since agreement was void as on Jan 31st, 2017 does notice period holds any value?
2.I have painted the house and cleaned it fully, should i still pay more for the rent.
3.Except the 6 days rent, maintenance, water expense should i pay any more to owner.
Pls guide me.
