Trade License - Milk and Dairy Products

Dear Sir, I have one Shop (Covered Area 149 Sq.Ft.) at Uttarpara, P.S. Uttarpara, Pin-712258, Dist. Hooghly, West Bengal purchased and Registered at Serampore Registry Office on 14.02.2013. At the time of purchase the Promoter/Developer/their nominated Advocate did not told me that west facing premises are shown in the Site Plan as Parking/Garage and sanctioned by the Uttarpara Kotrung Municipality, Uttarpara, Hooghly, West Bengal. There are several other premises (05 No.) which were registered as "Shop". After registry of my premises and other Premises as "Shop" and Flats in different floors (G+3), the next door neighbour at the inspiration of some local people filed a case against the landlord for illegal construction who afterwards in the year October, 2014 died at heart attack and his elder son left the house and I/we do not know about his whereabouts. The Hon'ble Kolkata High Court returned the case to the lower court at Serampore Sub Division Court who directed the Plaintiff, Defendant and Uttarpara Kotrung Municipality to site together and settle the matter. Now the matter is in status quo position and nobody is approaching to the court or settle the matter. Since my opening of my Shop Uttarpara Kotrung Municipality had issued to me the Trade License for the 2013-2014, 2014-2015, 2015-2016,2016-2017. Now they are reluctant to issue Trade License and told me that the case is pending before the Court so Trade License cannot be issued. When the Defendant and his son are nowhere, only the 03 partner are there, and the case is standing as is where is basis has Municipality any right to stop issuing the Trade License for the F.Y. 2017-2018 to a Retailer. I seek your valuable opinion regarding this. I have already paid my shop's Profession Tax for the F.Y. 2017-2018 two day's before though it was not necessary to pay now.
