Expulsion of a Commercial Owner as a member of society
The Society had build ( after regular follow up with builder) thru builder a compound wall in the Municipal Road Set Back Area in year 2010-2011
The Society was registered in Jan 2005 and OC was recd 2006
The Chairmans report for 2010-2011 states that after continuous follow up the builder built compound wall . A resolution was also passed on the suggestion of The Chairman that the wall height be increased to additional 2 feet .
I and 14 other shopkeepers had filed a complaint after few years with the Municipality ie, OCt 2015 and after several follows up the illegal wall was demolished
The Society has expelled me under s 35 stating that the wall was built by the builder and not the society , it was handed over to them during the handing over of society ( which is false) , they then say that even though it is municipal land the builder and Municipality has an agreement that the builder can use it for his purpose and the maintenance of the same is developers responsibility and the builder will hand over the same during the future Road Widening and stating that I am a shopkeeper and do not reside in the building , I have worked against the interest of the Society and hence violated section 35 and hence a resolution to that effect was passed
They have not even given reply to my letter ( June 2016) requesting to hand over my share certificate nor handed share certificate till date . I was unable to sell my shop also at good rate due to non availability of Share Certificate ( a important document of ownership)
