Payment Recovery

Respected Sir/Madam, I opted for VRS to take care of my twin kids in 2013. Some amount I invested as FD and some amount through my close relative I gave to a person whom we thought was the owner of the granite shop. Bcos he was running the shop for more than 18 yrs. For 2 yrs he paid us some amount as interest regularly. He has given cheques for the amount we have given him. But now he is not seen in the shop and when we enquired his elder brother in the shop says that he was his younger brother but due to the loss he made he has been sent out from the shop. Now we came to know that the granite shop belongs to his elder brother which he was taking care. Now he rarely picks calls or answers through whatsapp. Now we do not know his actual residence address to file a case. He says his wife & son also does not stay with him. Whenever we call he says he will not cheat us he will pay us back but don't know when. Please advice us what to do. He openly he does not have enough money now to run his daily life. Now what to do.
