Regarding harrasment of junior doctors and inhuman excessive work
Respected sir/madam, I am a junior Doctor working in Cardio-Thoracic Surgery Department as M Ch resident.. I want to report you a serious Harassment faced by resident doctors of this department.. here we are forced to do excessive duty hours by our head Prof. Dr. M A Geelani.. As per Government of India, CENTRAL RESIDENCY SCHEME, vide letter no. S-11014 /3/91/ME (P) dated 05 June, 1992, and hon'ble Supreme Court of India writ petition on 25.9.87, in writ petition No. 348-352 of 1985 : 1) No Senior Resident doctor shall be made to work NOT more than 48 hours per week 2) One day duty shall not be more than 12 hours in a single stretch 3) After a night duty, resident doctors should get a compensatory Off next day 4) Continuous active duty for resident doctors will not normally exceed 12 hours per day. Subject to exigencies of work the resident doctors will be allowed one weekly holiday by rotation. The resident doctors will also require to be on call duty not exceeding 12 hours at a time. The junior Residents should ordinarily work for 48 hours per week and not more than 12 hours at a stretch subject to the condition that the working hours will be flexible as may be decided by the Medical Superintendents concerned keeping in view the workload and availability of doctors for clinical work.”
That flexibility is given for ‘Working hours’ not for hours of work, that is, while authorities are free to post any doctor in day or night or in holidays, they must stick to the norms of “hours of work” that is Maximum 48 hours in a week and 12 hours. In no case resident doctors to be forced to work more than what is permitted by law and various recommendations in a single stretch. in a single stretch... but our head of department Dr. M A Geelani, Dr. Minhas, Dr. Subodh, Dr. Saket and Director of G B Pant hospital Dr. Chawla are not following rules and they are misleading government by saying that Resident doctors wants to do more duties willingly, but this is not true..they force us to sign a false undertaking that, whatever is written in this grievance is false and we have no problem in doing more duties, but we are suffering in this hospital,. they abuse us, our parents and repeatedly say that they will fail us in exams and will not teach us cardiac surgery if we dont do such duties. They say that they will fail us if we don't do duties said by them.. We are forced to do more than 100 hours per week without any break, this is more than double, that is 48 hours per week prescribed by Government..and we are not getting any compensatory off after night duty.. we are working continuously for 36 hours in a single stretch of duty during night duty,, which is also against 12 hours prescribed by government.. Our life, family and also patient care is going down because of this dictatorship of our head of department .. many of us are going in depression.. i files grievance with delhi government regarding this but i didnt get satisfactory reply
