Automatic notice period
Hi,
I am a tenant living in East Bengaluru. My contractual agreement is for 11 months on a rolling basis and stipulates the notice period as 2 months. However, my tenancy agreement expires in about a month from now (21st April 2017) and I informed my landlord yesterday that I would not wish to extend the contract and that I shall vacate the property before the end date. However, the landlord is quite upset about the "short notice" and says that I am legally bound to honour the 2 month notice clause, even though the contract ends in a month. Effectively, he is asking me to cough up an extra month's rent in lieu of the so called short notice.
I have been of the understanding that the notice clause applies only when either party (tenant or landlord) wishes to terminate the contract before the end of the tenancy period (usually 11 months in Bengaluru). I always understood this as the last 2 months to be within the "automatic notice period".
Any advice shall be greatly appreciated.
