Delayed Possession of the flat
Points
1. Have booked the flat on 27.9.2014, did a agreement of 12th of Dec'14 with the possession month of Dec'16 in agreement.
2. But till date flat is not ready and may we expect the possession by june'16 as per work.
3. But builder is saying u take the possession and start of your Furniture work..so by the time u can come live here.
4. When i asked him compensation on the delay possession, he come up with the different issues and causes.
5. Also he put some delayed payment charges in front of me the interest rate of 24% Per annum.
so due to delay payment from bank loan..he is saying to pay me of 52000.
6. and against the delayed payment he will be going to pay me of 6500 Rs per month as a rent..so in fact i will be in total loss basis on the agreement copy.
7. Now due to late possession, i cant claim tax exemption for this year(on interest paid on home loan amount)which will cause loss of almost 40-45K.
8. Also i am paying additional rent of almost 12k for my rented house.
9. Amount which i will have to pay to builder is remained of 5 Lakhs...out of 55 Lakhs(total cost).
Kindly suggest and help me on this so that i can be in WIN position over builder...
bcz my losses are too much...
