Property of my grandfather
My uncle (my father's elder brother) sue my grandfather for agriculture land as ancestral property and got decree in his favour in 1990. My grandfather was I'll that time and gave poa to person A to fight case on his behalf.
now the person A without my grandfathere consent agree in the court that property is ancestral. (Person A is very close friend of my uncle). it's just a whole game setup by my uncle to get the property. Soon after the decree like within 2 months my grandfather died. Even my father passed away after sometime. when I was about to be 18, I sue my uncle and won the case in view of birth right in ancestral property at lower court.
My uncle file an apeal at district court, which asks us to prove the property to be ancestral. When we check the records, it came out that property was purchased by my grandfather in 1944.
Now my question is property was not ancestral, so I can't claim my birth right in it. So decree which my uncle got it via poa to A person by my grandfather can be challenged or not? I mean my uncle puts a false claim in court of ancestral property. So what would happen if I sue my uncle based on the papers we got it?
Shall I go to high court with point that as my uncle got share in the property by saying its ancestral property and I should have also get my birth right in it or shall I disclose that my uncle puts a false claim and property should be taken back from my uncle and distribute as per his previous will or court will take decision as natural accession?
